Terms and Conditions

These Terms & Conditions (“Terms”) govern all services, proposals, and agreements provided by CT Window Replacement, LLC (“CTWR,” “we,” “our,” or “us”) to any homeowner or property owner (“Client,” “you,” or “your”).

By requesting a quote, approving work, or allowing installation to proceed, you agree to the following Terms.

1. Scope of Work

CT Window Replacement specializes exclusively in window replacement services. All work performed is limited to the scope specifically outlined in the approved proposal or agreement.

The following are not included unless expressly stated in writing:

• Structural repairs

• Framing or carpentry beyond window installation

• Siding, trim, or finish carpentry

• Rot remediation, mold remediation, or water damage repairs

• Lead or asbestos abatement

• Painting or staining

Any additional work requested outside the original scope may result in additional charges.

2. Window Product & Manufacturer Warranty

CTWR installs a single, standardized premium window system manufactured by Mercury Excelum / Earthwise Windows, engineered for New England homes and climate conditions.

• All performance specifications (energy efficiency, structural ratings, glass performance, etc.) are based on manufacturer-provided data

• Manufacturer warranties apply to window components including glass, seals, frames, vinyl components, and hardware

• CTWR does not manufacture windows and is not responsible for manufacturer defects beyond assisting with applicable warranty claims

Manufacturer warranty documentation is available upon request and governs all product-related claims.

3. Lifetime Transferable Warranty (Product & Installation)

CTWR provides a lifetime, fully transferable warranty that covers both window products and installation workmanship.

This warranty:

• Is valid for as long as the original purchaser owns the home

• Transfers to subsequent homeowners

• Covers installation workmanship and installation-related performance issues

• Includes manufacturer-covered window components as defined by the manufacturer

This warranty does not cover:

• Normal settling or movement of the structure

• Pre-existing structural or building envelope issues

• Damage caused by misuse, neglect, abuse, or lack of maintenance

• Damage caused by acts of nature or extreme weather events

• Alterations or repairs performed by third parties

Warranty claims must be reported within a reasonable time after discovery.

4. Lead Times & Scheduling

All windows are custom-manufactured after contract approval.

• Estimated production and installation timelines are approximate and not guaranteed

• Delays due to manufacturing schedules, material availability, weather, inspections, or circumstances beyond CTWR’s control do not constitute breach of contract

• CTWR reserves the right to reschedule installations for safety, weather, or operational reasons

5. Payment Terms

Payment terms are outlined in the approved proposal and may include:

• A deposit at contract approval

• Payments tied to material ordering or scheduling

• Final payment due upon substantial completion of installation

Failure to make timely payments may result in work delays, suspension, or legal remedies as permitted under Connecticut law.

6. Change Orders

Any changes to the original scope of work—including window size changes, configuration adjustments, glass options, or additional services—must be approved in writing and may result in price and timeline adjustments.

7. Existing Conditions & Concealed Damage

CTWR is not responsible for concealed or pre-existing conditions, including but not limited to:

• Wood rot

• Mold or moisture damage

• Insect damage

• Structural deficiencies

• Code violations resulting from prior work

Correction of such conditions is not included unless expressly agreed to in writing.

8. Permits & Code Compliance

Where required, CTWR will obtain applicable permits for window replacement work.

All installations are performed in accordance with:

• Manufacturer installation requirements

• Applicable Connecticut building codes in effect at the time of installation

CTWR is not responsible for bringing unrelated portions of the structure into code compliance.

9. Site Access & Preparation

Clients agree to:

• Provide clear and unobstructed access to work areas

• Remove window treatments, furniture, wall décor, and personal items near installation zones

• Secure pets and maintain a safe work environment

CTWR is not responsible for damage to items not removed from the work area.

10. Cosmetic Variations

Minor variations in color, finish, glass appearance, grids, or trim may occur due to manufacturing processes and material tolerances. Such variations within industry standards do not constitute defects.

11. Limitation of Liability

To the fullest extent permitted by law:

• CTWR’s total liability shall not exceed the total amount paid under the contract

• CTWR shall not be liable for indirect, incidental, or consequential damages, including loss of use, loss of energy savings, or diminution of property value

12. Cancellation Policy

Because windows are custom-manufactured, cancellations after order placement may result in forfeiture of deposits and/or charges equal to costs incurred for manufacturing, handling, and administrative expenses.

13. Force Majeure

CTWR is not liable for delays or failure to perform caused by events beyond its reasonable control, including acts of God, severe weather, supply chain disruptions, labor shortages, or governmental actions.

14. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of Connecticut.

15. Entire Agreement

These Terms are governed by and interpreted in accordance with the laws of the State of Connecticut.
